New York Becomes First US State To Freeze AI Data Centres Over Power, Water Fears

New York is set to become the first US state to impose a statewide moratorium on new hyperscale data centres, temporarily halting permits for facilities that support artificial intelligence workloads.

New York is set to become the first state in the United States to temporarily halt the construction of new large-scale artificial intelligence data centres, marking one of the country’s most significant regulatory interventions in the rapidly expanding AI sector. Governor Kathy Hochul is expected to sign an executive order imposing a statewide moratorium on new hyperscale data centres for up to one year while regulators develop environmental and energy standards for the facilities.

The decision reflects growing concerns over the enormous electricity and water requirements of hyperscale data centres, which house thousands of servers powering artificial intelligence applications. State officials argue that the rapid expansion of these facilities risks placing additional pressure on New York’s electricity grid, increasing utility costs for consumers and placing greater strain on local water resources used for cooling operations.

Under the executive order, New York will immediately suspend state permitting for new hyperscale data centre projects. During the moratorium, state agencies will be tasked with developing regulations covering energy consumption, environmental impact, water usage, grid reliability and other operational standards before additional projects are allowed to proceed.

“As data centre development threatens to hike up utility bills, deplete our natural resources, and create uncertainty for New Yorkers, it’s my responsibility to take action and lead,” Governor Kathy Hochul said while announcing the measure. Her office said the temporary pause is intended to ensure that future AI infrastructure development remains compatible with the state’s environmental and energy objectives rather than permanently blocking investment.

The announcement is expected to intensify debate over the balance between technological innovation and environmental sustainability. Technology companies and industry groups have argued that restrictions on hyperscale facilities could discourage investment, slow job creation and weaken the United States’ ability to compete with China in the global race to dominate artificial intelligence infrastructure.

The move also carries political implications ahead of New York’s gubernatorial election and congressional contests later this year. Hochul has increasingly emphasised affordability issues after previously softening some of the state’s greenhouse gas targets amid concerns over rising energy costs. Her Republican challenger, Nassau County Executive Bruce Blakeman, has opposed a statewide pause, arguing that local governments should retain the authority to negotiate data centre projects that promise economic benefits and employment opportunities.

Although New York has not yet emerged as one of the country’s leading destinations for hyperscale data centres, the executive order is likely to influence policy discussions nationwide as states grapple with the growing electricity demand created by artificial intelligence infrastructure.
